Thailand Supreme Court Recognizes Bitcoin as Legal Property

Edited by Grace Ezinne

Thailand’s Supreme Court has officially recognized Bitcoin as legal property, establishing a judicial precedent that clarifies how the digital asset is treated under the country’s legal system.

Although Thailand’s Securities and Exchange Commission (SEC) already regulates cryptocurrencies as digital assets, the ruling formally recognizes decentralized digital currencies as property that can be valued and legally owned under Thailand’s Civil and Commercial Code.

The decision also supports Thailand’s efforts to integrate regulated cryptocurrencies into traditional financial markets, following the recent approval of domestic Bitcoin and Ethereum exchange-traded funds (ETFs).

By recognizing Bitcoin as property, the court has established a clearer framework for resolving financial disputes involving asset seizures, corporate bankruptcies and inheritance claims. For institutional and retail investors in Thailand, the ruling clarifies the legal status of Bitcoin and strengthens the basis for protecting their ownership rights.

Bitcoin ownership does not make it legal tender

Despite this legal recognition, the Supreme Court’s ruling distinguishes between protecting Bitcoin as property and recognizing it as an official currency. Bitcoin can be legally owned and protected under property law, but it is not legal tender. Under Thailand’s Currency Act, decentralized digital assets cannot be used as legal tender to settle domestic debts or replace the national banking system.

X user Marina highlighted this distinction, noting that Thai residents can legally buy and own Bitcoin but cannot use it to make direct payments at local retail stores.

This separation serves an important economic purpose. By classifying Bitcoin as property rather than currency, Thailand can protect citizens’ digital assets without giving up control over its money supply or foreign exchange reserves. Investors must generally convert their cryptocurrency into Thai baht through licensed exchanges to use the funds for everyday purchases.

This process allows authorities to monitor capital flows, enforce capital gains taxes and maintain the national currency’s position in the domestic economy while still participating in the global cryptocurrency market.

Court ruling also strengthens legal protection against crypto theft

Before this judicial precedent, the lack of a clear legal definition of digital property could leave victims of cryptocurrency theft and corporate collapses with limited options for recovering their assets. When digital assets did not clearly qualify as property under the applicable legal framework, prosecuting hackers or recovering funds from a bankrupt centralized exchange could become more difficult.

X user Pro sniffer questioned the practical significance of the ruling, asking whether it primarily addresses ownership disputes and cryptocurrency theft rather than tax obligations.

However, the ruling addresses these concerns by clarifying how digital assets can be handled in civil disputes and criminal investigations. Another user, Skep, also observed that recognizing Bitcoin as property gives the public clearer legal avenues for seeking justice.

Where the applicable laws and court orders permit, authorities may also pursue the recovery of compromised assets or take action involving exchange accounts.

This legal clarity could help Thai investors seek restitution when cryptocurrency platforms collapse or suffer attacks, allowing them to pursue remedies through established property laws rather than relying solely on voluntary industry compensation or bailouts.
