The U.S. Securities and Exchange Commission (SEC) has officially dismissed its long-standing case against Ian Balina, a prominent cryptocurrency influencer and the founder of AI-driven investment platform Token Metrics.
In a joint filing submitted to a Texas federal court on May 1, the SEC stated it “believes the dismissal of this case is appropriate” and requested that the proceedings end without any costs or fees imposed on either party. The court filing did not elaborate on the reason behind the withdrawal but emphasized that the dismissal “does not necessarily reflect the Commission’s position on any other case.”
Balina, who gained widespread attention during the 2017 ICO boom, had signalled this outcome weeks earlier. On March 12, he announced on X that the case was being dropped, describing the development as a win for himself and the broader crypto community. “This was never just about me,” he wrote.
Token Metrics echoed that sentiment, suggesting the dismissal could signal a broader shift in how regulators approach crypto enforcement. In a tweet, the company hinted at a “trend of fairness returning to the space.”
The SEC charged Balina in 2022 for unlawfully promoting and reselling SPRK tokens related to the Sparkster project. The case involved a 2018 Telegram investing pool with around 68 participants, where Balina allegedly received a 30% bonus for promoting and reselling about $5 million worth of tokens without proper registration or disclosure. In May 2024, a court ruled that SPRK tokens were considered securities under the Howey Test and that Balina acted as an underwriter. The court also upheld the SEC’s charge for undisclosed paid promotions under Section 17(b) of the Securities Act.
The SEC also recently dropped a similar case against Hex founder Richard Heart on April 23, further signalling a possible change in enforcement strategy under the current administration. Sparkster and its CEO had settled with the SEC in 2022, agreeing to pay over $35 million to investors affected by the token offering.
