Following recent changes to its privacy policies, Google is now the target of a class-action lawsuit with serious allegations of privacy infringement and unauthorized use of copyrighted materials.
The lawsuit was filed on July 11, 2023, by eight individuals claiming to represent millions of internet users and copyright holders. They accused Google of violating their privacy rights by collecting and using their data without their consent.
According to court documents, the individuals claimed that Google had used data from Google Search, YouTube, and other Google products to train its AI systems. They argued that this data includes copyrighted material, such as images, videos, and text, and that Google has not obtained permission from the copyright holders to use.
The plaintiffs seeks damages of more than $5 billion and an order requiring Google to obtain explicit consent from users before collecting or using their data for AI training.
Google revised its privacy policies recently and included permissions that allow the company to use publicly accessible data for training its AI systems. However, this move has led to accusations that Google violated rights and gained an “unfair advantage” over competitors who acquire data for AI training through legitimate means.
Ryan Clarkson, the lawyer representing the eight plaintiffs, stated that Google must recognize that it does not possess absolute control over the internet, people’s creative works, personal expressions, family photos, or any other content posted online. Clarkson argued that the term “publicly available” does not imply that data can be freely used for any purpose without consent.
In a similar development, earlier this week, Sarah Silverman and two other authors filed a class-action lawsuit against OpenAI and Meta, the creators of ChatGPT and LLaMa. The authors accused the tech companies of utilizing copyrighted works to train their AI systems without seeking authorization. They also seek damage fees and an injunction prohibiting OpenAI and Meta from using copyrighted material without authorization.
