Prominent authors Richard Kadrey, Christopher Golden, and Sarah Silverman have filed a lawsuit against Meta and OpenAI on allegations of copyright infringement. The lawsuit centres around the unauthorized use of copyrighted content in the training datasets of both companies’ artificial intelligence (AI) tools: LLaMa and ChatGPT.
The authors claimed that the companies trained these comprehensive language models on content from diverse sources, including their works. They noted the content from their work was used “without consent, without credit, and without compensation.”
They also accused Meta and OpenAI of obtaining copyrighted data from “shadow libraries” such as Bibliotik, Library Genesis, and Z-Library. These websites, which provide access to copyrighted books through torrenting software, are deemed illegal, unlike open-source platforms such as Gutenberg, which compile books no longer protected by copyright.
In addition to individual copyright claims, the authors seek to represent a class of copyright owners in the United States whose works have allegedly been infringed by both Meta and OpenAI. The proposed class action lawsuit was officially filed in a federal court in San Francisco on July 7, 2023.
This lawsuit shed light on the development process of the new AI tools as well as the legal risks faced by developers who incorporate substantial amounts of copyrighted material into their programs.
Meanwhile, OpenAI has been under scrutiny from different global regulatory bodies regarding its data collection practices and privacy concerns. Notably, Japan’s Personal Information Protection Commission issued a warning letter to OpenAI on June 1, 2023, on worries about OpenAI’s collection of personal data without obtaining informed consent from individuals. Consequently, OpenAI was strongly advised by the commission to limit the collection of private information from Japanese residents for machine learning purposes or face strict regulatory measures.
These legal challenges and privacy-related issues underscore the complex landscape surrounding the use of copyrighted content and personal data in AI technologies. As the industry continues to evolve, companies must navigate these matters while upholding intellectual property rights and adhering to privacy regulations.
